Welcome to Band Social. These Terms of Use govern your access to and use of the Band Social website, platform, software, features, and related services available at https://band.social.

Band Social is operated by Lavinci Portugal Unip. Lda., with registered address at Avenida da República 6, 1º, 1050–191 Lisboa, Portugal (“Band Social”, “we”, “us”, or “our”).

By creating an account, accessing, or using Band Social, you agree to these Terms of Use. If you do not agree, you must not use the platform.

1. The Service

Band Social is a software-as-a-service platform designed for bands, artists, band managers, and music teams. It helps users manage social media scheduling and publishing, create public band pages, electronic press kits, event calendars, photo galleries, and related band operations.

The Service may include, among other features:

  • band profile management;
  • social media account connection (Facebook, Instagram, TikTok, YouTube);
  • social media post scheduling and publishing;
  • media file uploads (images, videos);
  • public band pages with customizable layouts;
  • electronic press kit (EPK) generation;
  • event and concert date management;
  • photo galleries and albums;
  • band member management;
  • band page analytics (views, link clicks, contact submissions);
  • calendar views;
  • AI-assisted content generation;
  • subscription and billing management.

We may update, improve, suspend, or discontinue parts of the Service from time to time.

2. Account Registration and Access

To use Band Social, you must create an account. Band Social supports Google authentication and email/password authentication.

You agree to provide accurate, complete, and up-to-date information when creating or using your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately at hello@backstager.io if you believe your account has been accessed without authorization.

We may suspend or disable your account if we reasonably believe that you have violated these Terms, used the Service unlawfully, created security risks, or caused harm to Band Social, other users, or third parties.

3. Band Subscriptions and Multi-Band Use

Band Social is organized around bands. Each band profile may contain its own social media accounts, posts, events, galleries, public page, and related data.

Band Social offers a free tier and a paid subscription per band. Each band is treated as a separate subscription unless otherwise agreed in writing.

You may cancel a subscription at any time. Cancellation will prevent future renewals but does not automatically entitle you to a refund except as described in Section 6.

4. Licence to Use Band Social

Subject to your compliance with these Terms and payment of applicable fees, Band Social grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own band, artist, management, or music business purposes.

You may not copy, resell, sublicense, rent, lease, distribute, or otherwise commercially exploit the Service except as expressly permitted by us in writing.

5. User Content and Data Ownership

You retain ownership of the information, files, text, images, videos, social media posts, band profiles, events, press kits, and other materials you upload, create, submit, or store in Band Social (“User Content”).

By using Band Social, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, transmit, display, and back up your User Content solely as necessary to provide, maintain, secure, and improve the Service.

You are responsible for ensuring that your User Content is accurate, lawful, and that you have the necessary rights or permissions to use it in Band Social.

We do not claim ownership of your band data, social media posts, media files, or business records.

6. Fees, Payments, and Refunds

Paid subscriptions are charged through Stripe, our payment processor. We do not store full card details on our own systems. Payment information is processed securely by Stripe in accordance with its own terms and privacy practices.

Prices are shown in euros unless otherwise stated. Applicable taxes may be added where required by law.

You authorize us and Stripe to charge your selected payment method for subscription fees and renewals.

Refunds

You may request a refund within 14 days of a paid subscription charge by contacting hello@backstager.io.

Refunds may be refused where there is evidence of abuse, fraud, repeated refund requests, or use of the Service in breach of these Terms.

7. Social Media Publishing

Band Social includes tools to connect social media accounts and schedule or publish posts to platforms such as Facebook, Instagram, TikTok, and YouTube.

You are responsible for ensuring that content you publish through Band Social complies with each platform's terms of service and community guidelines, as well as applicable laws.

We may suspend or restrict publishing capabilities if we detect abuse, platform violations, security risks, or unlawful use.

Band Social is not responsible for content removal, account suspensions, or other actions taken by third-party social media platforms.

8. Acceptable Use

You agree not to use Band Social to:

  • violate any applicable law or regulation;
  • infringe intellectual property, privacy, publicity, or other rights;
  • upload unlawful, defamatory, abusive, discriminatory, or harmful content;
  • send spam, phishing emails, malware, or fraudulent communications;
  • impersonate another person, band, company, or organization;
  • scrape, harvest, or extract data from the Service without permission;
  • attempt to gain unauthorized access to the Service, accounts, systems, or networks;
  • interfere with, overload, damage, or disrupt the Service;
  • reverse engineer, decompile, or attempt to discover the source code of the Service;
  • bypass security, usage limits, billing systems, or access controls;
  • resell or provide the Service to third parties without written authorization;
  • use Band Social to build a competing product or service by copying its features, structure, interface, or database design.

9. Third-Party Services

Band Social may rely on third-party service providers, including cloud hosting and database providers, Stripe for payments, social media platform APIs, authentication providers, cloud storage providers, and other technical vendors needed to operate the Service.

We are not responsible for disruptions, data loss, outages, or errors caused by third-party providers outside our reasonable control, but we will take reasonable steps to maintain service reliability and security.

Your use of third-party services may also be subject to their own terms and policies.

10. Intellectual Property

Band Social, including its software, design, interface, workflows, branding, logos, content, documentation, and underlying technology, is owned by Lavinci Portugal Unip. Lda. or its licensors and is protected by applicable intellectual property laws.

Except for the limited licence granted to you under these Terms, no rights are transferred to you.

You may not copy, modify, reproduce, distribute, publish, display, create derivative works from, or exploit any part of Band Social without our prior written consent.

Feedback, suggestions, or ideas you provide about Band Social may be used by us without restriction or compensation, provided we do not disclose your confidential User Content.

11. Privacy and Data Protection

Our processing of personal data is described in our Privacy Policy. By using Band Social, you acknowledge that we process personal data as described in that policy.

Band Social is operated from Portugal and is intended to comply with applicable Portuguese and European Union data protection requirements, including the General Data Protection Regulation (GDPR), where applicable.

12. Availability and Changes to the Service

We aim to keep Band Social available and reliable, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, technical issues, third-party provider issues, or events outside our reasonable control.

We may add, change, or remove features at any time. Where a material change significantly affects your paid use of the Service, we will take reasonable steps to notify you.

13. Disclaimers

Band Social is provided on an “as is” and “as available” basis.

We do not guarantee that the Service will meet every user requirement, secure any booking, produce any specific commercial result, or ensure engagement from social media audiences.

Band Social is a social media management and band promotion tool. It does not provide legal, financial, accounting, tax, or professional advice.

You are solely responsible for decisions made based on your use of the Service.

14. Limitation of Liability

To the maximum extent permitted by law, Band Social and Lavinci Portugal Unip. Lda. will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, data, opportunities, or business interruption.

To the maximum extent permitted by law, our total aggregate liability arising from or relating to the Service will not exceed the amount you paid to Band Social in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where it cannot be excluded or limited under applicable law.

15. Indemnity

You agree to indemnify and hold harmless Band Social, Lavinci Portugal Unip. Lda., its directors, employees, contractors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

  • your use or misuse of the Service;
  • your breach of these Terms;
  • your User Content;
  • content you publish through Band Social to social media platforms;
  • your violation of law or third-party rights.

16. Termination

You may stop using Band Social at any time. You may cancel your subscription through the platform where available or by contacting us at hello@backstager.io.

We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, misuse the Service, create risk for us or other users, or where required by law.

After termination, we may retain certain data where required for legal, accounting, tax, security, fraud prevention, or legitimate business purposes, as explained in the Privacy Policy.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal.

Any dispute arising from or relating to these Terms or the use of Band Social shall be subject to the competent Portuguese courts, without prejudice to any mandatory consumer rights that may apply under applicable law.

18. Changes to These Terms

We may update these Terms from time to time. When changes are material, we will take reasonable steps to notify you, such as by email or through the platform.

The updated Terms will apply from the date they are posted or otherwise communicated. Your continued use of Band Social after changes become effective means you accept the updated Terms.
